A valid notice must include everything 17 U.S.C. §512(c)(3) requires. A notice that is missing any of these is not a valid notice and we may not act on it:
Before you send a notice, consider whether the use is licensed, authorized, or fair use. Under 17 U.S.C. §512(f), anyone who knowingly materially misrepresents that material is infringing may be liable for damages, including costs and attorneys’ fees.
On receipt of a valid notice we remove or disable access to the material identified, notify the member who posted it, provide that member a copy of the notice including the complainant’s contact information, and record the notice against the account. We may remove material on a first notice at our discretion, and we may act before a notice is complete where the infringement is plain. Removal is not an admission that the material infringes.
If you believe your material was removed by mistake or misidentification, you may send a counter-notice to the designated agent. A valid counter-notice must include:
We forward valid counter-notices to the original complainant. Unless the complainant tells us within 10 business days that they have filed a court action seeking to restrain the material, we may restore it between 10 and 14 business days after receiving the counter-notice. We are not obliged to restore material that violates our Terms or Acceptable Use Policy on other grounds. A counter-notice that knowingly misrepresents that material was removed by mistake is itself actionable under §512(f).
We terminate, in appropriate circumstances, the accounts of members who are repeat infringers, and we may do so after a single notice where the infringement is flagrant. We count valid notices against an account whether or not a counter-notice follows, and we keep a record of notices, counter-notices, and actions taken. Terminated accounts forfeit passes, credits, and content as the Terms provide, and a person whose account was terminated for infringement may not open another.
You are responsible for having every right you need in anything you upload, process, remix, sample, or sell, including the rights of co-writers, performers, producers, and sample owners, and for any licence a cover recording or a remix needs. By using MXR 3000 or any upload feature you represent that you own or have permission for the material. Unauthorized use of copyrighted material results in removal and account action, and you indemnify SceneTown for claims arising from it under the Terms.
